Véritable® Indoor Garden Warranty Terms & Conditions
The information below is relevant for all Véritable® Indoor Garden units sold by Mr Fothergill's Seeds Pty Ltd.
WARRANTY DETAILS
INDOOR GARDEN WARRANTY
Véritable® grants the customer a free national guarantee which takes effect on the date of delivery.
The product is only guaranteed if the product is used in accordance with the instructions and for its intended purpose.
Claims will only be accepted on the submission of proof of the purchase from the Mr Fothergill's website or from one of our authorised Australian resellers and accompanied by its purchase invoice.
The Customer has a period of two years from the delivery of the goods to act as a legal guarantee of conformity, subject to the conditions under the Competition and Consumer Act 2010 and similar state and territory laws.
The warranty includes the replacement of parts and labour.
LINGOTS® WARRANTY
Véritable® designs and markets live products. As the natural seed germination rate is between 65% to 95%, we cannot guarantee 100% germination. To ensure maximum satisfaction, we offer a guarantee on our Lingots®.
The Lingot® guarantee is valid for any purchase of a Veritable Lingot® on the Mr Fothergill's website or from one of our authorised resellers (we reserve the right to request proof of purchase prior to accepting your warranty claim).
For any request for coverage under warranty, please contact us by sending us a photo of the Lingot® in your Véritable Indoor Garden and indicating the variety and date of planting.
If your Lingot® is diagnosed as non-compliant, we will ship a new Seedless Lingot® free of charge. To be effective, the request for warranty coverage must take place between 20 and 30 days following the planting date of the Lingot®.
The Lingots® are guaranteed for 1 year from the date of purchase (date of the invoice). Lingots® will only be covered by warranty if grown using a genuine Véritable Indoor Garden unit. Replacements will only be shipped to an Australian address.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
PROOF OF PURCHASE – This warranty is valid for the original purchase and is not transferable. Please keep your purchase docket, tax invoice or receipt as proof of purchase, and proof of date on which the purchase was made.
NORMAL WEAR AND TEAR – This warranty does not cover normal wear and tear to the products or parts.
EXCLUSIONS -
- Warranty exclusions related to the origin of the damage:
The Véritable® guarantee does not apply in the event of accidental material damage, it does not cover in particular deterioration and breakdowns resulting from:
- improper installation or improper use or maintenance of the product, including:
- inappropriate use of the equipment or not following the instructions in the user manual;
- use of energy not in accordance with the manufacturer's instructions
- addition of fertiliser, soil or other products not recommended by Véritable ®
- addition of parts that do not comply with those recommended by the manufacturer;
- opening and modification of the content of the guaranteed product;
- lightning, flood, fire, overvoltage, shock, poor ventilation, fall, discoloration due to the action of light, burning, humidity, excessive heating or the presence of insects or diseases;
- repairs carried out and / or any intervention on the equipment and / or opening thereof by a person other than Véritable® customer service
- maintenance, repair or replacement of parts due to normal wear and tear or lack of maintenance
- corrosion, oxidation, a bad connection or an external power supply problem. If, for example, a connection is made to a defective outlet, the warranty will not apply.
- If the device or the Lingots® are stored in an inappropriate space (damp room, too hot room, outdoor storage, etc.).
Warranty exclusions related to the nature of the damage (indirect damage): The Véritable® warranty only covers the right to repair or replacement of the guaranteed product. Consequently, indirect damage resulting from failure or deterioration is not covered by the warranty.
Other exclusions:
- Damage and breakdowns falling under the specific exclusions provided for in the user manual
- Guaranteed products that the Customer is unable to return or those returned without their accessories;
Indemnity
To the full extent permitted by law, you will indemnify Mr. Fothergill’s Seeds Pty Ltd and keep Mr. Fothergill’s Seeds Pty Ltd indemnified from and against any liability and any loss or damage Mr. Fothergill’s Seeds Pty Ltd may sustain, as a result of any breach, act or omission, arising directly or indirectly from or in connection with any breach of any of these terms or the User Instructions by the you or your representatives.

When making a return, please ensure the product is properly packaged so as to ensure that no damage occurs to the product in transit. Please provide the original or a copy of the proof of purchase. Please also make sure you have included an explanation of the problem as well as your contact details.
